How foreclosure and tax sales work in Texas

General rules. Procedures vary by county, so confirm with the official office.

Texas mostly uses nonjudicial foreclosure under a power of sale in the deed of trust or mortgage, and the property is sold by a substitute trustee at the county courthouse.

Texas generally sells a deed to tax-delinquent property through the county sheriff or a constable, but the former owner can still redeem it for a set period after the sale.

Foreclosure and tax sales are held on the first Tuesday of each month between 10 a.m. and 4 p.m. at the place the county commissioners designate.
